Cyprus communal fees follow the flat. Clear arrears before you complete

In Cyprus, unpaid communal fees on a jointly owned building can follow the flat into your ownership. A signed sale contract does not clear them. Before you complete, get a written arrears certificate from the management committee.

Communal fees are a legal duty, not a soft request

Where a building is registered as jointly owned under Cap. 224, common expenses sit in statute. The management committee must exist, insure the building, maintain common property, set lawful contributions, and keep accounts. Your share is usually based on the contribution ratio in the building regulations, typically by unit area, not an equal split per flat.

A vacant unit does not automatically stop the bill. An unused pool or lift still attracts contribution if your unit is entitled to use it under the regulations. Treat communal fees as part of ownership cost alongside electricity, water and insurance. For indicative ranges, see the typical running costs briefing.

Why UK buyers get caught after completion

Sellers sometimes leave unpaid levies, special works contributions, or disputed balances. Cyprus practice can allow recovery against the owner when the levy was decided and against the owner when proceedings are filed, on a joint and several basis. That is why documented clearance matters before transfer, not after keys change hands.

Buyers used to a more informal management-committee culture often treat the certificate as optional paperwork. In Cyprus it is one of the checks a competent independent lawyer should insist on. See also independent lawyers for Cyprus property.

What to obtain in writing before you complete

  • A written committee certificate of contributions and arrears
  • Recent accounts, budgets and any reserve or sinking-fund position
  • Building insurance particulars (fire, lightning and earthquake cover is compulsory at replacement value)
  • Relevant resolutions and details of planned major works

Ask what the monthly or annual contribution is now, whether an increase is expected, and whether large repairs are already priced into next year’s budget. A low asking price looks different once a lift replacement or façade project is on the committee agenda.

Do not rely on the reform bill yet

A Jointly Owned Buildings Bill has been discussed, including ideas such as a maintenance fund and stronger supervision. As of mid-2026 it was still described as pending. Proposed reforms are not current law until enacted. Buy and diligence against Cap. 224 and the registered regulations as they stand today.

How Cyprus Gate fits

Cyprus Gate acts only for the buyer. We hold no developer inventory and take no seller commissions. More on our stance: about independence.

For the full Cap. 224 mechanism, committee duties, FAQ set and sources, read the common expenses in jointly owned buildings briefing. This post is general information about practice in the Republic of Cyprus, not legal advice. Confirm the position for your building with an independent Cyprus lawyer before you commit.
