Cyprus residency when your spouse is an EU, EEA or Swiss citizen

Last reviewed: 1 October 2026

For non-EU nationals (including post-Brexit UK) whose spouse or civil-union partner is an EU, EEA or Swiss citizen living in the Republic of Cyprus, the usual path for a stay over three months is a family-member residence card (commonly MEU2). Buyer-side orientation only, not legal advice. Confirm eligibility with a licensed Cyprus immigration lawyer.

Briefing Contents

Who this briefing is for

Non-EU buyers whose spouse or civil-union partner is an EU, EEA or Swiss citizen considering life or property in the Republic of Cyprus (not Northern Cyprus).

If your partner holds an EU, EEA or Swiss passport, sequence immigration status with any property plan before you assume a ~€300,000 Regulation 6(2) investment permanent-residency purchase is required. Cyprus Gate acts for the buyer on property and relocation sequencing; we do not file MEU applications, check permits or title ourselves, or give case-specific immigration advice.

MEU2 versus ~€300k investment permanent residency

MEU2 is EU free-movement family-member residence orientation under Cyprus domestic law (Directive 2004/38/EC / Law 7(I)/2007 as amended). Regulation 6(2) investment PR is a separate third-country route often marketed around a ~€300,000 qualifying property.

Official Migration Department material covers entry and residence of third-country family members of an EU/EEA citizen (MEU2), and MEU1/MEU2/MEU3 residence cards. “Family member” usually includes spouse or civil-union partner, certain descendants under 21 or dependants, and dependent ascending relatives – confirm current gov.cy wording. A genuine relationship and the Union citizen’s exercise of residence rights in the Republic of Cyprus are central; do not DIY eligibility.

If a genuine EU-family-member route applies, some buyers do not need the investment-PR threshold for immigration – that is not a guarantee. A licensed Cyprus immigration lawyer confirms. You may still buy property for living, yield or planning; immigration status, purchase permission (including Cap. 109 where relevant) and which home is worth buying are different questions.

MEU2 published steps (orientation)

Up to three months with a valid passport while accompanying or joining the Union citizen; for longer stays apply for MEU2 within four months of entry; biometrics; published €20 fee; decision within six months if complete; card typically five years.

Published expectations at submission include the Union citizen attending with the family member, evidence of sufficient resources, relationship documents, the Union citizen’s registration certificate where appropriate, translations/certification as required, and biometrics for adults. Exact checklists change – use current gov.cy material with your lawyer. After five consecutive years of legal residence, MEU3 (permanent residence card) may be available under published rules; that is a later step. Retention after divorce, death or departure of the Union citizen is condition-heavy – instruct counsel, do not self-assess.

Not tax residence; sequencing for the household

Published rule: family members enjoy free access to employment. MEU2 is immigration status, not Cyprus tax residency, not citizenship, and not automatically the same as investment PR.

Holding MEU2 does not by itself make you a Cyprus tax resident, a non-dom, or a citizen. 60-day / 183-day tax residency and non-dom are separate frameworks. Buying property does not by itself create MEU2 rights. See the 60-day rule, permanent residency by property investment, the parent tax, residency and structuring hub, and relocation and residency coordination.

EU Spouse Residency Route: Frequently Asked Questions

Do I need the €300,000 investment route if my spouse is Irish (or another EU citizen)?

Not automatically. If a genuine EU-family-member route applies under published free-movement rules, some buyers do not need Regulation 6(2) investment PR for immigration. Eligibility is fact-specific. Confirm with a licensed Cyprus immigration lawyer before you skip or commit to an investment-PR purchase.
